New Hampshire Question 1, on the ballot Tuesday, Nov. 3, asks voters whether to eliminate the elected office of register of probate from the state constitution.
The legislature's adopted amendment, CACR 13, says the office's duties were redistributed to circuit court clerks in 2011. The proposal removes references to registers of probate from constitutional articles 71 and 81.
A register of probate is an elected county office. Article 81's rule barring judges from acting as counsel in probate matters remains.
A yes vote supports removing the office. A no vote keeps the constitutional language. Approval requires two-thirds of the people voting on the amendment, and the change takes effect when the governor proclaims its adoption. A blank answer is not counted as a vote on the question.
